In interviews, reality television personality Kim Kardashian has admitted that she knew “right away” that her marriage to NBA player Kris Humphries was a mistake. What she did not realize in all probability was that undoing that mistake would last longer than the couple’s entire relationship. The cause of the delay is that Kardashian wants a divorce while Humphries wants an annulment on the grounds of fraud.
Kardashian has yet to be deposed in the matter, but her attorney told the court recently that the lengthy court case has handcuffed his client to her estranged spouse. She would like to move on with her life, Kardashian’s attorney said — and entertainment columnists interpret that as a reference to Kardashian’s hope to marry boyfriend Kanye West — but Humphries is dragging his feet. Her attorney has maintained from the beginning that any divorce settlement would be dictated by the couple’s prenuptial agreement. Humphries, however, is sticking to his guns on the fraud claim.
Humphries’ legal team has, in fact, failed to present evidence of fraud. His attorney stated that they are waiting for information from the producers of and network behind Kardashian’s show. He also indicated that he should have the specifics of the fraud claim nailed down soon. If he prevails, the prenuptial would be void, and Humphries could wind up with a larger settlement.
The parties will return to court in February, at which time they will finally set a date for trial. The judge has not set deadlines for discovery — depositions and other pre-trial investigations — but did say that it could happen quickly after the Feb. 15 court date.
