Do you know how spousal support is determined?

When a couple goes through divorce, the property division process receives a lot of attention. Along with this, there may come a time when people feel that they should receive spousal support. This is typical when one partner was financially dependent on the other.

If you feel that spousal support is your right, it is important to understand what the court considers. Furthermore, you need to know how the amount of spousal support is calculated.

The court does not have a set criteria for determining whether or not to award spousal support. Additionally, there is no system in place for determining how long it should be paid or the monthly amount.

The Uniform Marriage and Divorce Act, however, is something that many states take into consideration. This helps states decide which factors to consider when awarding spousal support. Some of these factors include:

— The length of the marriage.

— The age and physical condition of the spouses.

— The financial condition of the spouses.

— The length of time that the person requesting spousal support would need to become self sufficient.

Once all of these factors are taken into consideration, the court can make a final decision as to whether one person should receive spousal support.

You are going to have many questions as you go through divorce, some of which may be associated with spousal support. If you believe you are entitled to this benefit, you will have your chance to convince the court. Knowing how spousal support is determined will allow you to make your best case.
