Are you going through divorce? Do you own a home with your soon-to-be former spouse? If so, you have many questions to answer. After all, it is not feasible for the two of you to share the home any longer.
This will bring forth a variety of questions, some of which are difficult to answer. Even so, you must settle on an answer to each question if you plan on putting this behind you once and for all.
Here are several questions to answer in regards to divorce and the family home:
— Should you fight to keep the home?
— Will you owe anything to your spouse if you end up staying in the home?
— What happens if you are the person leaving the home in the past?
— What steps should you take if you are leaving the home and your name is on the mortgage?
— Will the divorce process impact the ability to secure a mortgage for a new home?
— What is the process for determining which person gets to keep the home?
These are all important questions to address. For example, if you get the family home, your spouse may end up with something else of value. You have to consider the pros and cons of both staying in and leaving the home.
Not every divorce leads to questions of who stays in the family home, but this often comes into play. If you have children, the question is even more complex. By understanding your rights and options, you can make a better decision.
